第1条（総則）

本利用規約（以下「本規約」）は、Snooze 5運営者（以下「運営者」）が提供するiOSアプリ「Snooze 5」（以下「本アプリ」）の利用条件を定めるものです。ユーザーは、本アプリを利用することにより、本規約に同意したものとみなします。本規約は日本語を正文とし、英語版は参考訳とします。

第1条の2（サービス概要・動作環境）

本アプリは、スヌーズ機能付きアラームを提供するiOSアプリです。Apple AlarmKitを使用しており、アラームはiOSのシステムレベルで管理されます。

1. 動作対応環境：本アプリはiOS 26.4以降を搭載したiPhoneを対象としています。対応OS・デバイスの最新情報はApp Storeの製品ページに記載します。
2. アプリの表示言語：日本語・英語・繁体字中国語に対応しています。
3. 機能変更について：本アプリの機能は、アップデートにより追加・変更・削除される場合があります。重要な変更が生じた場合は、App Storeのアップデート履歴にてお知らせします。
4. サービス終了について：運営者が本アプリのサービスを終了する場合、可能な限り30日前までにApp Storeページにてその旨を記載します。

第2条（利用許諾）

運営者は、本規約に従うことを条件に、本アプリを個人的・非商業的目的に限り使用する、取り消し可能・非独占的・譲渡不可のライセンスをユーザーに付与します。

第2条の2（未成年者の利用）

1. 本アプリは13歳以上のユーザーを対象としています。
2. 18歳未満の方が本アプリの有料機能を購入するには、親権者または法定代理人の同意が必要です。
3. 運営者は13歳未満のユーザーから意図的に個人情報を収集しません。

第3条（禁止事項）

1. 本アプリを複製、改変、逆コンパイル、リバースエンジニアリングすること
2. 本アプリを商業目的で再配布または販売すること
3. 本アプリを違法な目的に使用すること
4. 本アプリに含まれる著作権・商標等の表示を削除または変更すること

第4条（アラーム機能に関する重要事項）

本アプリはApple AlarmKitを使用しており、アラームはサイレントモードや集中モードを越えて通知するよう設計されています。ただし、以下の場合にアラームが正常に動作しない可能性があります。

1. ユーザーがアラームの使用許可を付与していない場合（アラームは動作しません）
2. デバイスのバッテリーが切れた場合、または電源がオフの場合
3. Appleのシステム側でアラームがキャンセルされた場合（OSのアップデート中、デバイスの再起動直後等）
4. デバイスのストレージ不足等、端末側のリソース制約がある場合

第4条の2（無料お試し期間と課金）

1. 無料お試し期間：本アプリは、App Storeが署名したアプリ取得日時を起算日として、同じApple Accountにつき1回、7日間の無料お試し期間を提供します。お試し期間中はすべての有料機能を無料で利用でき、期間終了後は有料機能がロックされます。自動的な課金やサブスクリプション登録は発生しません。
2. 買い切り購入：お試し期間終了後に有料機能を継続してご利用いただくには、App Store経由で一度だけお支払いいただく買い切り形式です。購入後は追加費用なく永続的にご利用いただけます。
3. 返金ポリシー：本アプリの課金はすべてApp Store（Apple Inc.）経由で処理されます。返金が必要な場合は、Appleのサポートにお問い合わせください。

第4条の3（プライバシー・個人情報保護）

1. データの保存・参照について：本アプリが端末内に保存する設定等のデータは、ユーザーの端末内にのみ保存されます。無料お試しの起算日と購入情報は、Apple StoreKitの署名済み取引情報を参照します。アプリ本体から運営者サーバーへの自動送信は存在しません。ただし、ユーザーが任意でご意見箱を利用した場合、入力内容は運営者に送信されます。

3. 第三者サービス：課金処理はApple Inc.のApp Store（StoreKit）経由でのみ行われます。運営者が独自に利用する第三者決済サービスはありません。
4. プライバシーポリシー：詳細はプライバシーポリシーをご参照ください。

第5条（知的財産権）

本アプリに関するすべての知的財産権は運営者に帰属します。

収録音源「クリスタル・チャイム」「リトル・マリンバステップ」「やさしく目覚める静音アラーム」には、smartomaizu 提供素材を使用しています。各素材は Creative Commons Attribution 4.0 International（CC BY 4.0）に基づき、アプリ用に長さの調整とファイル形式の変換を行っています。

第6条（保証の否認）

1. 本アプリは「現状有姿」かつ「提供可能な状態」で提供されます。運営者は、商品性・特定目的への適合性・非侵害性を含む一切の明示的または黙示的保証を行いません。
2. 運営者は、Apple Inc.その他の第三者が提供するサービス・システムの動作について保証しません。
3. 運営者は、バグ修正・アップデートの提供・特定の機能の継続提供を義務として負うものではありません。

第7条（責任の制限）

1. 運営者の故意または重大な過失に基づく損害については、本条の免責は適用されません。
2. 運営者は、軽過失による間接損害・特別損害・偶発的損害・結果的損害（アラーム不鳴動による寝坊・遅刻・機会損失等を含むがこれに限らない）については、責任を負わないものとします。
3. 消費者契約法が適用される場合において、本条の免責規定は同法の範囲内でのみ有効とします。
4. 本アプリの有料機能に関し運営者の責任が認められる場合の賠償額の上限は、ユーザーが支払った購入代金の総額とします。

第8条（規約の変更）

1. 運営者は、法令の改正・サービス内容の変更・その他合理的な必要性がある場合に、本規約を変更することができます。
2. 規約を変更する場合、運営者はApp Storeのアップデート履歴に変更内容を記載します。
3. 変更後の規約の効力発生日以降に本アプリを継続して使用した場合、ユーザーは変更後の規約に同意したものとみなします。

第9条（準拠法・管轄）

1. 本規約は日本法に準拠します。
2. 本規約に関する紛争については、法令上認められる範囲で、運営者の住所地を管轄する日本の裁判所を専属的合意管轄裁判所とします。
3. EU居住のユーザーに対しては、GDPRその他の欧州連合の強行法規が準拠法・管轄の定めに関わらず適用されます。

第10条（Appleに関する条項）

1. 本規約は、運営者とユーザーの間の契約であり、Apple Inc.との契約ではありません。本アプリに関する一切の責任は、Appleではなく運営者が負います。
2. 本アプリの利用許諾は、ユーザーが所有または管理するAppleブランド製品上で、Apple Media Services利用規約に定める利用ルールに従って本アプリを使用するための、譲渡不能なライセンスに限られます。
3. Appleは、本アプリに関するメンテナンスおよびサポートを提供する義務を負いません。
4. 本アプリに何らかの不具合がある場合、ユーザーはAppleに通知することができますが、AppleはApp Store購入代金の返金以外の責任を負いません。
5. 本アプリまたは本規約に関するユーザーの主張に対して、Appleは何らの責任も負いません。
6. 本アプリに第三者の知的財産権を侵害するコンテンツが含まれている場合、運営者が対応責任を負い、Appleは責任を負いません。
7. ユーザーは、本アプリの利用にあたり、Apple Media Services利用規約その他適用される第三者の利用規約を遵守するものとします。
8. ユーザーは、米国および日本の輸出規制に関連する法令を遵守することに同意します。また、米国政府の禁輸対象国またはテロ支援国家に指定された国に所在しておらず、米国政府の禁止または制限対象者リストに掲載されていないことを表明し、保証します。
9. Appleおよびその子会社は、本規約の第三者受益者です。ユーザーが本規約に同意した時点で、Appleは第三者受益者として本規約をユーザーに対して執行する権利を有するものとします。

Article 1 (General Provisions)

These Terms of Use ("Terms") govern the use of the iOS application "Snooze 5" ("App") provided by the Snooze 5 operator ("Operator"). By using the App, you agree to be bound by these Terms.

Article 1-2 (Service Overview and Compatibility)

The App is an iOS alarm application featuring snooze functionality, powered by Apple AlarmKit.

1. Supported Environment: The App is designed for iPhone running iOS 26.4 or later.
2. App Display Languages: Japanese, English, and Traditional Chinese.
3. Feature Changes: Features may be added, modified, or removed through updates. Significant changes will be announced via App Store release notes.
4. Service Discontinuation: If the Operator decides to discontinue the App, this will be noted on the App Store page at least 30 days in advance, where reasonably possible.

Article 2 (License)

Subject to these Terms, Operator grants you a revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

Article 2-2 (Minor Users)

1. The App is intended for users aged 13 and older.
2. Users under 18 require parental or guardian consent to purchase paid features.
3. The Operator does not knowingly collect personal information from children under the age of 13.

Article 3 (Prohibited Activities)

1. Copy, modify, decompile, or reverse engineer the App
2. Redistribute or sell the App for commercial purposes
3. Use the App for any unlawful purpose
4. Remove or alter any copyright or trademark notices contained in the App

Article 4 (Important Information Regarding Alarm Functionality)

The App uses Apple AlarmKit, which is designed to alert through Silent Mode and Focus. However, alarms may not function correctly in the following circumstances:

1. If the user has not granted alarm permissions (alarms will not function at all)
2. If the device battery is depleted or the device is powered off
3. If Apple's system cancels the alarm (e.g., during an OS update or immediately after a device restart)
4. If the device has insufficient storage or other resource constraints

Article 4-2 (In-app Trial Period and Billing)

1. Free trial period: The App offers one seven-day free trial per Apple Account, measured from the App Store-signed app acquisition date. All paid features are available during the trial. After the trial ends, paid features are locked. No automatic charge or subscription is created.
2. One-Time Purchase: To continue using paid features after the in-app trial period, a one-time purchase is required via the App Store. Once purchased, you may use the App permanently with no additional fees.
3. Refund Policy: All purchases are processed through the Apple App Store. For refund requests, please contact Apple Support. The Operator has no authority to issue refunds for App Store transactions.

Article 4-3 (Privacy and Personal Data)

1. Data Storage and Reference: App settings and other data stored locally by the App remain solely on the user's device. The App references Apple StoreKit's signed transaction information for the free-trial start date and purchase status. The App does not automatically send data to the Operator's server. If you voluntarily use the Feedback Box, the content you enter will be sent to the Operator.
2. Types of Data Collected:

3. Third-party services: Paid purchases are processed only through Apple Inc.'s App Store and StoreKit. The Operator does not use a separate third-party payment service.

Article 5 (Intellectual Property)

All intellectual property rights in and to the App belong to the Operator.

The included sounds “Crystal Chime,” “Little Marimba Step,” and “Gentle Quiet Alarm” use material provided by smartomaizu under the Creative Commons Attribution 4.0 International license (CC BY 4.0). The material was trimmed and converted to an app-compatible file format.

Article 6 (Disclaimer of Warranties)

1. The App is provided "as is" and "as available." The Operator makes no representations or warranties of any kind, express or implied.
2. The Operator does not warrant the operation of third-party services including Apple Inc.
3. The Operator is under no obligation to provide bug fixes, updates, or continued availability of any particular feature.

Article 7 (Limitation of Liability)

1. This limitation of liability does not apply to damages caused by Operator's willful misconduct or gross negligence.
2. Operator shall not be liable for any indirect, special, incidental, or consequential damages (including but not limited to missed alarms, tardiness, or loss of opportunity) arising from Operator's ordinary negligence.
3. Where the Japanese Consumer Contract Act applies, this limitation shall only be effective to the extent permitted by such Act.
4. To the extent Operator is found liable for damages relating to paid features, Operator's total liability shall not exceed the purchase price paid by the user.

Article 8 (Amendments to These Terms)

1. Operator may revise these Terms when required by changes in applicable law, modifications to the Service, or other reasonable grounds.
2. When these Terms are revised, the Operator will note the changes in the App Store release notes.
3. Continued use of the App after the effective date of any revised Terms constitutes acceptance of those Terms.

Article 9 (Governing Law and Jurisdiction)

1. These Terms shall be governed by and construed in accordance with the laws of Japan.
2. Any disputes shall, to the extent permitted by applicable law, be subject to the exclusive jurisdiction of the courts having jurisdiction over Operator's place of residence in Japan.
3. For users residing in the European Union, the GDPR and other mandatory EU regulations shall apply regardless of this governing law clause.

Article 10 (Apple-Related Provisions)

1. You acknowledge that these Terms are concluded between you and Operator only, and not with Apple Inc. Operator, not Apple, is solely responsible for the App and its content.
2. The license granted to you is limited to a non-transferable license to use the App on Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
3. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
4. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you.
5. Apple is not responsible for addressing any claims by you or any third party relating to the App.
6. In the event of any third-party intellectual property infringement claim, Operator, not Apple, will be solely responsible.
7. You must comply with the Apple Media Services Terms and Conditions and any other applicable third-party terms of agreement when using the App.
8. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting country, and that you are not listed on any U.S. Government prohibited or restricted parties list.
9. Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary thereof.

本使用條款（以下稱「本條款」）規定由 Snooze 5 營運方（以下稱「營運方」）提供之 iOS 應用程式「Snooze 5」（以下稱「本應用程式」）之使用條件。使用者一旦使用本應用程式，即視為同意本條款。本條款以日文版為正本，中文版僅供參考翻譯。

第1條之2（服務概要・運作環境）

本應用程式為具備貪睡（Snooze）功能之鬧鐘應用程式，採用 Apple AlarmKit，鬧鐘由 iOS 系統層級管理。

1. 適用環境：本應用程式適用於搭載 iOS 26.4（含）以上版本之 iPhone。對應作業系統與裝置之最新資訊請參閱 App Store 產品頁面。
2. 應用程式顯示語言：支援日文、英文、繁體中文。
3. 功能變更：本應用程式之功能可能因更新而新增、變更或刪除。如有重大變更，將於 App Store 更新紀錄中告知。
4. 服務終止：若營運方決定終止本應用程式服務，將在合理可行範圍內，至少於30天前在 App Store 頁面公告。

第2條（使用許諾）

營運方在使用者遵守本條款之前提下，授予使用者一項可撤銷、非獨家、不可轉讓之授權，僅限於個人、非商業用途使用本應用程式。

第2條之2（未成年使用者）

1. 本應用程式適用對象為13歲以上之使用者。
2. 未滿18歲之使用者購買本應用程式付費功能時，須取得監護人或法定代理人之同意。
3. 營運方不會刻意蒐集未滿13歲使用者之個人資料。

第3條（禁止事項）

1. 複製、改作、反編譯或逆向工程本應用程式
2. 以商業目的重新散布或販售本應用程式
3. 將本應用程式用於非法目的
4. 刪除或變更本應用程式所含之著作權、商標等標示

第4條（關於鬧鐘功能之重要事項）

本應用程式採用 Apple AlarmKit，其設計為可跨越靜音模式與專注模式發出通知。惟在以下情況下，鬧鐘可能無法正常運作：

1. 使用者未授予鬧鐘使用權限時（鬧鐘將無法運作）
2. 裝置電池耗盡或電源關閉時
3. 因 Apple 系統端取消鬧鐘時（例如作業系統更新中、裝置重新啟動後等）
4. 裝置儲存空間不足等裝置端資源限制情況

第4條之2（免費試用期間與付費）

1. 免費試用期間：本應用程式以 App Store 簽署之應用程式取得日時為起算日，每個 Apple Account 可享有一次為期7天之免費試用期間。試用期間內可免費使用全部付費功能，期間結束後付費功能將被鎖定。不會產生自動扣款或訂閱。
2. 買斷制購買：試用期間結束後，如欲繼續使用付費功能，須透過 App Store 進行一次性付款之買斷制購買。購買後即可永久使用，無需額外費用。
3. 退款政策：本應用程式之付費項目一律透過 App Store（Apple Inc.）處理。如需退款，請洽Apple 支援。

第4條之3（隱私權・個人資料保護）

1. 資料儲存・參照方式：本應用程式於裝置內儲存之設定等資料，僅儲存於使用者裝置中。免費試用起算日與購買資訊，係參照 Apple StoreKit 已簽署之交易資訊。應用程式本身不會自動向營運方伺服器傳送資料。惟若使用者自願使用意見箱功能，其輸入內容將傳送至營運方。
2. 蒐集之資料類型：

第5條（智慧財產權）

本應用程式相關之所有智慧財產權均歸營運方所有。

收錄音源「水晶鐘聲」、「小馬林巴階梯」、「輕柔靜音鬧鐘」使用smartomaizu 提供之素材。各素材依據 Creative Commons Attribution 4.0 International（CC BY 4.0）授權條款，並為配合應用程式進行長度調整與檔案格式轉換。

第6條（免責聲明）

1. 本應用程式係以「現狀」及「可提供之狀態」提供。營運方不作任何明示或默示之保證，包括但不限於商品性、特定目的適用性及不侵權之保證。
2. 營運方不保證 Apple Inc. 或其他第三方所提供服務、系統之運作。
3. 營運方無義務提供錯誤修正、更新，或持續提供特定功能。

第7條（責任限制）

1. 因營運方故意或重大過失所生之損害，不適用本條之免責規定。
2. 對於因營運方輕過失所致之間接損害、特別損害、附隨損害、衍生性損害（包括但不限於因鬧鐘未響導致之睡過頭、遲到、機會損失等），營運方不負賠償責任。
3. 若適用消費者契約法之情形，本條免責規定僅於該法許可範圍內有效。
4. 就本應用程式付費功能，若營運方之責任成立，其賠償上限為使用者已支付之購買金額總額。

第8條（條款之變更）

1. 營運方得於法令修正、服務內容變更或有其他合理必要時，變更本條款。
2. 變更本條款時，營運方將於 App Store 更新紀錄中記載變更內容。
3. 變更後條款生效日以後，使用者若仍繼續使用本應用程式，即視為同意變更後之條款。

第9條（準據法・管轄權）

1. 本條款以日本法為準據法。
2. 有關本條款之爭議，於法令許可範圍內，以營運方所在地之日本法院為專屬合意管轄法院。
3. 對於居住於歐盟之使用者，不論本條準據法及管轄之約定為何，GDPR 及其他歐盟強制性法規均予適用。

第10條（關於 Apple 之條款）

1. 本條款為營運方與使用者間之契約，並非與 Apple Inc. 之契約。有關本應用程式之一切責任由營運方承擔，Apple 不負任何責任。
2. 本應用程式之使用授權，僅限於使用者於其擁有或管理之 Apple 品牌產品上，依 Apple Media Services 使用條款所定使用規則使用本應用程式之不可轉讓授權。
3. Apple 無義務對本應用程式提供維護及支援服務。
4. 若本應用程式有任何瑕疵，使用者可通知 Apple，惟 Apple 除退還 App Store 購買金額外，不負其他責任。
5. 對於使用者就本應用程式或本條款所提出之任何主張，Apple 不負任何責任。
6. 若本應用程式含有侵害第三方智慧財產權之內容，由營運方負責處理，Apple 不負責任。
7. 使用者於使用本應用程式時，應遵守 Apple Media Services 使用條款及其他適用之第三方使用條款。
8. 使用者同意遵守美國及日本有關出口管制之相關法令，並聲明保證其並非位於美國政府禁運國家或被列為支持恐怖主義國家之地區，亦未被列於美國政府禁止或限制對象名單中。
9. Apple 及其子公司為本條款之第三方受益人。使用者一旦同意本條款，Apple 即有權以第三方受益人身分對使用者執行本條款。
